Terms of Use

Effective date: October 20, 2026

The short version: MergePro is free, open-source software provided as is. It acts on GitHub and on your local repositories only when you tell it to, and you are responsible for those actions. Keep backups. GitHub’s own terms still apply. These terms are not a substitute for the software license, which is the Apache License 2.0.

1. Agreement

These Terms of Use (“Terms”) apply to the MergePro macOS application (the “App”) and the website at mergepro.app (the “Website”), both provided by Jonathan Sudhakar (“we”, “us”). By downloading, installing or using the App, or by using the Website, you agree to these Terms. If you do not agree, do not use the App or the Website.

2. License

The App’s source code is licensed under the Apache License, Version 2.0 (the “License”). Your rights to use, copy, modify and distribute the source code are set out in the License. Nothing in these Terms limits the rights the License grants you; where these Terms and the License conflict regarding the source code, the License controls.

If you obtain the App from the Mac App Store, your use of that copy is also governed by Apple’s Licensed Application End User License Agreement and the App Store terms. Apple is not responsible for the App or for supporting it.

3. Your responsibility for actions you take

MergePro acts on your behalf, using your GitHub credentials and on folders you choose. Depending on what you do, it can submit reviews and comments, change labels and other pull request details, merge or enqueue pull requests (including stacks of pull requests), run workflows, approve or reject deployments, create or delete branches, and run Git commands such as commit, checkout, stash, pull and push in your local repositories.

  • You are solely responsible for every action MergePro performs at your direction, on GitHub and on your Mac, and for its consequences.
  • Read confirmations and option dialogs carefully before you confirm them. Safeguards in the App (such as checking the expected head commit before a merge) reduce risk but cannot remove it.
  • Keep backups of your work and repositories, and make sure you have the authority to make the changes you ask MergePro to make in repositories owned by you or others.

4. Third-party services

The App works with GitHub, a service operated by GitHub, Inc. Your use of GitHub through the App is subject to the GitHub Terms of Service and any other GitHub terms that apply to you or your organization. We do not control GitHub and are not responsible for its availability, behavior, changes to its API, or any action it takes on your account. Other services you reach through the App (for example Git remotes or editors on your Mac) are governed by their own terms.

5. Acceptable use

You agree to use the App and the Website lawfully and in line with GitHub’s terms and acceptable use policies, including its API rate limits. Do not use the App to access accounts or repositories you are not authorized to access, to send spam or abusive content, or to interfere with GitHub or any other service.

6. No warranty

The App and the Website are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the App will be uninterrupted, error-free, secure, or compatible with GitHub or your system. You use the App and the Website at your own risk.

7. Limitation of liability

To the maximum extent permitted by law, in no event will Jonathan Sudhakar or any contributor to MergePro be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, code, repositories, branches, commits, merges, deployments, credentials, profits, revenue, goodwill or business, or for business interruption, arising out of or related to the App, the Website or these Terms, however caused and under any theory of liability (contract, tort including negligence, strict liability or otherwise), even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims relating to the App, the Website or these Terms is limited to the amount you paid us for the App, which for the free App is zero (US $0).

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you. In that case, our liability is limited to the smallest amount permitted by law.

8. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Jonathan Sudhakar and MergePro’s contributors from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from your use of the App or the Website, actions performed through the App at your direction, your violation of these Terms or of GitHub’s terms, or your violation of anyone else’s rights.

9. Trademarks

“MergePro” and the MergePro logo and icon are trademarks of Jonathan Sudhakar. They are not licensed under the Apache License 2.0; as Section 6 of that License states, it does not grant permission to use trade names, trademarks or product names. If you distribute a modified version of the App, please give it a different name and icon.

GitHub is a trademark of GitHub, Inc. Mac, macOS and App Store are trademarks of Apple Inc. MergePro is an independent project and is not affiliated with, endorsed by or sponsored by GitHub, Inc. or Apple Inc.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and update the effective date. Continuing to use the App or the Website after a change means you accept the updated Terms.

11. General

Severability. If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect.

No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.

Entire agreement. These Terms, together with the License, the Privacy Policy and, for App Store copies, Apple’s Licensed Application End User License Agreement, are the entire agreement between you and us about the App and the Website.
